The penalties for identity theft depend primarily on the effect of the deception and the intent of the accused. On its own, identity theft is a Class D felony that can lead to 1 year in prison and a fine as high as $10,000. If more than 100 victims are involved, or if the fraud reaches higher than $50,000, the crime becomes a Class C felony. A Class C felony could get you 2 to 8 years in prison and a fine starting at $10,000.
If the perpetrator uses a synthetic identity, meaning creating details of their own, this is a Level 6 felony; if more than 100 victims are involved, or the crime involves more than $50,000, it is a Level 5 felony. A Level 6 felony can lead to 6 years to 2 ½ years in prison and a fine of up to $10,000. A Level 5 felony can result in 1 to 6 years in prison and a similar fine.
