Penalties for OWI with a Minor in the Vehicle in Indiana
When you are at least 21 years old or older and commit an OWI offense with a minor in your vehicle who is under 18 years of age while your BAC is .15 or higher, you may be charged with a Level 6 felony. A Level 6 felony is punishable by a prison sentence between six months and two and a half years, as well as a maximum fine of $10,000.
However, if you have been convicted of a previous OWI causing serious injury or death within five years, the crime is considered a Level 5 felony. A Level 5 felony is punishable by a prison sentence between one and six years and a maximum fine of $10,000.
