What Happens to Your Driver’s License After an OWI?
In Indiana, if a police officer sees you driving and suspects you are impaired or intoxicated, you will be pulled over and likely given a breath or blood test, as well as a field sobriety test. If you are arrested for DUI or OWI, your license will initially be suspended by the BMV for 180 days, usually starting at your first court hearing. Based on the circumstances of your arrest, you may receive restricted driving privileges during that suspension. However, if you refuse to submit to testing, this will lead to an immediate one-year license suspension. Refusal suspensions can sometimes be fixed with the help of an experienced attorney.
If you are convicted with a DUI or OWI, your driver’s license may be suspended for up to two years. More typical suspensions are between 90 and 180 days, but suspensions vary greatly based on your record and on what county you are charged in.
